C-Pon (KOC / JAPAN Co., Ltd.) Membership Agreement
Article 1 (general rules)

The C-Pon Membership Agreement (hereinafter referred to as the "Terms") is a service related to KOC JAPAN Co., Ltd. (hereinafter referred to as the "Company") and C-Pon (hereinafter referred to as the "Service". ) Shall apply to all relationships with all users.

Article 2 (Definition of terms)

  1. "Member" means a person who has agreed to this agreement, registered the necessary information specified by the Company, and received approval from the Company. (Procedures from the registration information to our approval (hereinafter referred to as "member registration")

  2. "Terms, etc." is a general term for these Terms, precautions for using this service, terms, guidelines, etc.

Article 3 (Scope of application)

This agreement stipulates the handling of C-pons issued by our company. Members shall fully understand the contents of this agreement and agree to this agreement before purchasing and using C-pon.

Article 4 (Member)

Members can use this service in accordance with the conditions set by the Company. However, when using this service, you may be asked to agree to the terms and conditions (hereinafter referred to as "individual terms and conditions") separately set by the external interlocking payment system.

Article 5 (Membership registration procedure)

  1. Entering member information When registering as a member, please understand the prescribed precautions and register the necessary information accurately.

  2. Membership Qualifications Individuals who have agreed to this agreement and applied for the prescribed membership registration will be qualified as members by undergoing the registration procedure specified by the Company and receiving approval from the Company. The registration procedure must be done by the member himself / herself. Registration by proxy is not permitted at all. In addition, we may refuse registration applications from those whose membership has been revoked in the past or those who we judge to be unsuitable.

  3. Registered e-mail address For the e-mail address to be registered at the time of registration, please register the e-mail address owned by the member. Registration with another person's e-mail address will not be accepted. If the e-mail address is shared by multiple people such as a company, school, or family member, the member will be allowed to register with the e-mail address with the consensus of the co-owner. However, even in this case, the use of this service shall be limited to the registrant himself.

  4. Multiple registrations One user may not be able to register multiple members or hold membership status.

  5. Information and Communication We may send notifications to the member's email address and phone number entered when registering as a member.

Article 6 (Scope of use)

C-Pon can be used at the member stores posted on our website for the purchase of goods or the provision of services within the range of the C-Pon balance.

Article 7 (Issuance of C-pon)

  1. C-Pon can be purchased on our website using our designated credit card.

  2. We will notify the purchaser of C-Pon of the ID and password by the method of sending an e-mail.

  3. You can purchase C-pons in units of 1,000 yen.

  4. Members who purchase C-pons shall be charged 1,000 points of C-pons for every 1,000 yen purchased. (1C pon = 1 yen)

  5. C-pons charged on the web application can be settled at 1C-pon = 1.25 yen when making payments at our affiliated stores, and you will always receive food and drink and services at a discounted price of 20% or more. Is possible.

  6. The maximum amount of one purchase of C-pon is 50,000 yen. However, you can purchase as many times as you like, as long as the purchase is not fraudulent, such as violating these Terms.

Article 8 (Management of ID and password)

  1. Since C-pon is used by entering the issued ID and password, the member manages the ID and password at his / her own risk and is careful not to be known to others. Please be careful.

  2. If the member forgets the ID or password, we will reissue the ID or password by contacting us by the method prescribed by our company.

  3. Even if the C-pon is stolen, forged or altered, or if the ID or password is used by a third party without the permission of the member, we will not be liable for any damages caused by it.

Article 9 (Change of member registration information)

If there is a change in the information registered as a member, please register the change immediately. The Company is not liable for any damages caused by failure to register the change. In addition, even if change registration is made, transactions that have already been processed before change registration will be performed based on the information before change registration. If you need to notify us of any changes to your registration information regarding such transactions, please contact the service provider directly from the member.

Article 10 (member withdrawal)

If a member wishes to withdraw from the membership, the member himself / herself must complete the withdrawal procedure.

Article 11 (Intellectual Property Rights)

  1. Unless otherwise specified, intellectual property rights (copyrights, trademark rights, design rights, portrait rights, etc.) and other rights related to this service belong to the Company or the right holder, and members respect those rights. Shall be.

  2. Members shall not obtain the permission of the Company or the right holder for all information, images, etc. obtained by this service, beyond the scope explicitly permitted by the private use of individuals stipulated in the Copyright Law and other laws. , All or part of these may not be used, reprinted, duplicated, distributed, modified, etc.

Article 12 (Use of C-pon)

  1. When a member purchases goods or receives services at a member store of the Company, in order to settle this consideration, the member moves to the website designated by the Company and enters the member's ID and password to join. You can use the C-Pon by scanning the QR code installed in the store with the camera, entering and confirming the payment amount.

  2. If it is confirmed that the price of the transaction selected by the customer is within the balance of C-pon, we will notify the member store to that effect. If the member store approves this, it will be deemed that the payment has been made by deducting the amount equivalent to the transaction price from the balance of C-pon, up to the balance of C-pon.

  3. In the case of the preceding paragraph, the price and the balance of C-pon after payment will be displayed on our designated website, so members should confirm that they are correct.

  4. If the balance of C-pons presented by the member is less than the price, the transaction will not be settled and you will have to pay separately by the other method.

  5. In the event of a return, defect or other problem after using C-Pon in a transaction between a member and a member store, the member and the member store shall resolve the problem.

Article 13 (How to check the balance of C-pon)

You can check the balance of C-pon by entering your ID and password on our designated website.

Article 14 (Refund of C-pon, etc.)

Members cannot refund or redeem the balance of C-Pon except as required by law. However, if the Company completely abolishes the handling of C-Pon due to changes in economic conditions, revision or abolition of laws and regulations, or other reasons, the balance of C-Pon will be refunded to the members by the method prescribed by the Company.

Article 15 (Suspension of use of C-pon and expiration of C-pon)

The Company shall be able to suspend the use of C-Pon or revoke C-Pon in any of the following cases.

  1. When the customer acquires the C-pon by an illegal method, or knows that it is a C-pon acquired by an illegal method and uses it.

  2. If the C-pon is forged or altered

  3. If you violate this agreement

  4. In addition to the items listed in the preceding items, if the Company determines that there is a considerable reason for the need to suspend the use of the C-pon.

  5. If the user goes into bankruptcy (bankruptcy if it is a corporation) procedure, the C-pon issued by the Company shall expire.

Article 16 (C-pon usage period)

The period of use of C-pon is 6 months from the date of purchase of C-pon. Please note that the C-pon that has passed the usage period will expire and you will not be able to use it. In this case, no refund will be given regardless of the balance of C-pon.

Article 17 (Cancellation or suspension of use of C-pon)

When we recognize that it is necessary to stop or suspend the system due to system maintenance, communication line or communication means, computer failure, etc., we will stop using C-pon or stop using C-pon without notifying the customer in advance. It may be interrupted.

Article 18 (Changes or abolition of this agreement)

  1. This agreement and the range of member stores that can be used may be changed or abolished due to changes in economic conditions, revision or abolition of laws and regulations, or other circumstances of the Company. In addition, due to such changes or abolition, the use of all or part of the C-pon may be suspended.

  2. When this agreement is changed or abolished, we will notify you by displaying it on our website.

  3. The Company shall be able to revise this agreement without prior notice to the members. The changed Terms shall be applied in preference to the past Terms, and shall become effective when posted on the Service. By using this service after the change, the member is deemed to have agreed to the changed terms.

Article 19 (C-pon sending function)

The "Send C-Pon" function is intended to be used when multiple people send out C-Pon and one of the representatives makes a C-Pon payment at the time of payment, and the C-Pon is sent to one of the representatives. You can use this function when sending.
The maximum amount that can be sent from one account per day is 50,000 yen [40,000 C-pon], and sending in excess of that is prohibited.
Use other than this purpose, such as money laundering, is prohibited.

Article 20 (Our exemption from liability)

  1. The Company infringes the authenticity and the rights of third parties regarding the usefulness, suitability, completeness, accuracy, safety, legality, up-to-dateness, etc. of all information provided by the member stores. We do not guarantee that you have not done so.

  2. Please contact the member store directly for matters related to linked campaigns conducted by the member store. We do not take any responsibility unless we knowingly or grossly neglect. In addition, even if we are liable, our liability shall be limited to direct and ordinary damages.

  3. In the case of intentional or gross negligence of the Company regarding system interruption, delay, cancellation, data loss, damage caused by unauthorized access to the data, and other damage caused to the member regarding this service of the Company due to a failure of the communication line or computer. Unless otherwise, we do not take any responsibility. In addition, even if we are liable, our liability shall be limited to direct and ordinary damages.

  4. We do not guarantee that the email content sent from our web pages, servers, domains, etc. does not contain harmful things such as computer viruses.

  5. The Company is not liable for any damages caused to a third party due to the member's violation of this agreement.

Article 21 (Prohibited matters)

  1. When using this service, members are prohibited from doing the following items 1 and 2 below.

    1. Violation of laws and regulations or this agreement, or any act that may cause it.

    2. Damage the rights, interests, honor, etc. of the Company and other third parties.

    3. Acts that may adversely affect the mind and body of young people, or other acts that are offensive to public order and morals.

    4. Performing fraudulent use such as fraud against the Company, or acts equivalent to fraudulent use.

    5. Performing a criminal act or an act that leads to a criminal act.

    6. In addition to the items listed in the preceding items, perform serious acts that damage the relationship of trust with the Company.

  2. ​ Redemption of C-pons and coupons (paper vouchers issued by the Company) given in specific campaigns is considered to be for money laundering purposes and is prohibited.
    In addition, store owners and related parties who have signed a member store contract use the C-pon and coupons (paper vouchers issued by the Company) given in a specific campaign to settle the C-pon at their own store. Doing so is considered to be fraudulent and prohibited.
    If you conspire with our affiliated stores and come into contact with the above prohibited items, you will immediately confiscate your C-pon balance and coupons, and your membership will be forfeited, and you will be prohibited from registering as a member or using our services in the future.

Article 22 (Handling of personal information)

  1. We handle personal information of members in accordance with our privacy policy. In addition, we may formulate individual terms and conditions that apply individually to the external payment service established by the Company, so when using it, we may formulate individual terms and conditions that apply to the service regarding the handling of personal information of the external payment service. Please check etc.

  2. Even if the member suspends the use of this service or withdraws from the membership system unique to this service (regardless of the reason), unless the member requests the deletion of personal information, we will do so at our discretion. It shall be possible to dispose of it after the lapse of the storage period deemed appropriate.

Article 23 (Exclusion of antisocial forces)

Members are antisocial forces (gangsters, gangsters, those who have not been members of gangsters for less than 5 years, quasi-members of gangsters, companies related to gangsters, general assembly shops, etc. Etc., etc., and other persons equivalent to this), or we will continue to state that we will not engage in illegal acts such as violent acts, fraudulent acts / threatening acts, and business obstruction acts. If you violate such a statement, you will accept measures such as deregistration of the member, suspension of use of this service, and cancellation of individual contracts related to transactions without objection.

Article 24 (Governing Law)

This agreement shall be construed based on Japanese law.

Article 25 (jurisdiction)

If a proceeding is required for a transaction based on this agreement, the Tokyo District Court shall be the exclusive agreement jurisdictional court of the first instance.
